Kelowna Cruelty to Animals Charge

Just heard on Global about a man in Kelowna convicted of cruelty to animals. He apparently kicked two kittens, one ended up with brain damage, the other lost its tail. The man was given 50 hours of community service. Apparently he has anger management problems and a drinking problem. Anyone know if the charges laid were under the criminal code or under the PC Act?
