40 seized cats are healthy enough to be rehomed?

In the above article by Kent Spencer, this statement is made, "Of the 49 cats, one has died, eight are in a clinic, and the SPCA is trying to find homes for the rest."
This seems to imply that of the 49 cats seized, 40 are healthy enough to be adopted at this time.
Then why were they seized if they were not very sick? Couldn't Penny just have been made to treat them, instead of them being seized?
